Terms of Service

What you agree to when you use Incarn: your rights, our commitments and the rules of the service.

Your memories stay yours. We never sell your photos, we do not use them to train models, and nothing is published without your consent.

This is a translation of the French Terms of Service, which prevail in case of difference.

1. Purpose

These Terms of Service (the "Terms") govern access to and use of the Incarn service, available at incarn.co (the "Service"), and the purchases made on the Service. By using the Service, you accept these Terms.

The Service is published by a sole trader registered in France ("Incarn"): their identity, postal address and SIRET number are given in the legal notice.

2. Description of the Service

Incarn is an online service that uses artificial intelligence to animate photos (portraits, family photos, historical photos). You upload a photo and receive a short animated video. The Service runs on prepaid credits, with no subscription.

The Service also offers:

the family film, which puts your animations together into one film with a title, a dedication and music (section 4.3);
gift cards, to give animations to someone close to you (section 4.4).

3. Access to the Service

The Service is open to individuals aged 18 or over. A first animation is free after a quick sign-up by email (1 credit given at sign-up). You access your account and buy more credits after signing in by email.

4. Prices, payment and right of withdrawal

4.1 Prices and payment

Prices include all taxes and are shown in the currency displayed at the time of purchase. Payment is made in full when you order and is processed by Stripe: Incarn never sees or stores your card details. A receipt is emailed to you after each purchase.

4.2 Credit packs

Animations are bought in prepaid packs, with no subscription. One credit creates one animation. Purchased credits have no expiry date.

4.3 Family films

The do-it-yourself film. You choose 10 to 25 of your purchased animations, a title, a dedication and a piece of music; the Service edits them into one film, delivered in the format of your choice: for television (landscape) or for phones (portrait).

It is free with each pack of 25 or 50 credits you buy for yourself (one film per pack bought).
A first film is also free for accounts that had 10 or more HD animations on 16 October 2026.
Otherwise, the film costs 49 €.
The second format (one film for television and one for phones) costs 19 € more, including for a free film.

The film is an MP4 video file (H.264) that plays on phones, computers and TVs. You will find it in your account, and its sharing link stays active for as long as the film and your account exist.

The done-for-you film ("We take care of everything, ready in 24 hours"). You send your photos and your choices; Incarn animates the photos and edits the film.

Price: 99 € for up to 25 photos and one format; 29 € more for up to 50 photos; 19 € more for the second format. The total price is shown before payment.
What you receive: a video film bringing together the photos the Service was able to animate, in the order you sent them, with the title, dedication, music and look you chose. Movements, expressions and framing are generated by artificial intelligence: they are imagined, may differ from reality and vary from one photo to another. This is not a lack of conformity, and your aesthetic view of the result gives no right to a new film or to a refund.
There is no preview before payment: sample films are shown on the website, and payment means you accept this way of making the film.
A photo that cannot be animated (moderation refusal, refusal by the artificial intelligence provider, repeated technical failures) is left out of the film, with no replacement after delivery. The price does not change, unless the number of animated photos drops to the lower tier: the tier difference is then refunded automatically. With fewer than 10 animated photos, the order is cancelled and fully refunded.
The film is delivered by email, to your account address, no later than the deadline shown before payment, and it stays available in your account. If it is not delivered by that deadline, you may ask us to deliver it within a reasonable additional period; if it is still not delivered at the end of that period, you may cancel the order and receive a full refund (article L216-6 of the French Consumer Code).
Express option: 199 € extra. It can be ordered Monday to Friday, 8 am to 6 pm (Paris time), and the film is delivered within the 2 business hours following payment, counted Monday to Friday from 8 am to 6 pm. To meet this deadline, a photo that could not be animated is not replaced: the film is made without it. If the express film arrives after this deadline, the 199 € for the option is refunded automatically, with no action needed on your part; this is the only compensation owed for the delay.
After delivery, "Edit my film" allows up to 5 changes: title, dedication, music, look, photo order and removing photos. No new photo or new animation is possible: any other request is a new order.
You guarantee that you hold the rights to the photos you send and the consent of the people shown (article 6). An order whose photos breach article 6 is cancelled; the part already done remains payable.

4.4 Gift cards

A gift card contains a single-use code, to be redeemed at incarn.co/redeem for the credits of the chosen pack. The code has no end date: it stays valid until it is redeemed. It is cancelled if the purchase of the card is refunded. The credits received have no expiry date. Buying a gift card gives no credits to the buyer.

The gift card for the film made for you is used on the film order form. It is valid for 1 year from purchase: the date is shown on the card and in the confirmation email. If an order paid with it is cancelled, the card can be used again, for at least 30 days.

4.5 Right of withdrawal

You have 14 days from the day of purchase to withdraw from the contract, without giving any reason and at no cost. To do so, you may:

use the Withdraw from contract here page (linked at the bottom of the site's pages, in your account menu and in every receipt): the "Withdraw from contract here" button, then "Confirm withdrawal". If you are not signed in, the page asks for the email used for the purchase and the order number shown on the receipt;
use the model withdrawal form below;
send any other clear statement of your decision to withdraw to [email protected].

A withdrawal made online is acknowledged immediately by email, with the date and time. A statement sent by email is acknowledged without delay.

When the right of withdrawal ends. To enjoy your purchase straight away, without waiting for the withdrawal period to end, you tick a box before payment by which you ask for the content to be supplied immediately and acknowledge that you lose your right of withdrawal once it has been supplied. With this consent:

credit pack: the right ends for each credit used. Unused credits remain refundable, in proportion to the price paid for the pack, and they are removed from the account when refunded;
pack of 25 or 50 credits: once the free film that comes with the pack is ready, you can no longer withdraw from the pack. Until that film is ready, withdrawing from the pack also cancels the right to the free film, and the film started with that right;
gift card: the right ends as soon as the code is redeemed;
do-it-yourself film and second format: the right ends as soon as the film is ready;
done-for-you film: the right ends as soon as the film is ready. Before then, since you asked us to start making it straight away, you pay for the part already done (article L221-25 of the French Consumer Code): the animations account for 90 % of the price, shared equally between the photos of the order, and each photo already animated remains payable. Only the rest is refunded.

Before those points, withdrawal gives you a full refund of the purchase, except the part of a done-for-you film already made.

Refund. We refund you no later than 14 days after your withdrawal, using the same means of payment as for the purchase, at no cost.

Business purchases. Purchases made for business purposes, such as API access (API terms), carry no right of withdrawal.

4.6 Legal guarantee of conformity

Animations and films are digital content. They are covered by the legal guarantee of conformity for digital content (articles L224-25-12 and following of the French Consumer Code) for 2 years from their supply: content that does not conform is made again or, failing that, refunded, at no cost. Write to [email protected] describing the defect.

The photos are animated with artificial intelligence: the movements are imagined, not filmed. Every film says so.

4.7 Technical failure

If an animation cannot be created because of a technical failure of the Service, the credit is returned automatically.

4.8 Price changes

Prices may change for the future. A purchase remains governed by the prices and terms accepted at the time of purchase, and credits already bought remain usable at no extra cost.

5. Intellectual property

Your content: you remain the owner of your photos. By uploading them, you grant Incarn a limited, non-exclusive and temporary licence to process them technically in order to create the animation and the film. This licence ends when your content is deleted.
Videos and films: the animations and family films created by the Service are licensed to you for personal and family use (keeping them, showing them and sharing them with the people close to you). Incarn claims no rights over them. Any commercial use requires Incarn's prior written consent ([email protected]).
The Service: the website, its code, design, trademarks and editorial content are the exclusive property of Incarn and are protected by intellectual property law. Any reproduction without permission is prohibited.

6. User obligations and strictly prohibited uses

By using the Service, you declare that you are an adult (18 or over) and undertake to comply with these obligations. Any breach may lead to immediate suspension of the account without notice or refund, and to a report to the competent authorities where the law requires it.

In particular, you undertake to:

Only upload photos you hold the rights to or have express permission to use.
Never upload or attempt to animate a photo showing a minor in a sexual, degrading or ambiguous manner. Any attempt to generate content involving child sexual abuse will be reported to the French PHAROS platform (article 227-23 of the French Criminal Code) and identification data will be passed to the competent authorities.
Not use the Service to generate pornographic, sexual, nude, degrading or violent content.
Not use the Service to generate content showing an identifiable person without their consent (image rights, articles 226-1 and 226-8 of the French Criminal Code).
Not generate content that undermines the dignity of a deceased person without the express permission of their heirs.
Not generate unlawful, defamatory, hateful or racist content, or content inciting violence, discrimination or hatred.
Not use the Service for fraud, identity theft, malicious deepfakes, blackmail or harm to the safety of others.
Not circumvent, disable or attempt to circumvent the moderation filters, whether automated or manual.
Not attempt unauthorised access to the Service's systems, servers, accounts or data.

You acknowledge that you alone are responsible for the content you upload and have the Service generate. You hold Incarn harmless against any claim, action or judgment resulting from use that does not comply with these Terms, and will compensate it for any resulting loss (financial, legal or reputational).

6a. Automated and manual moderation

The Service applies several layers of moderation:

Automated moderation by the AI providers. Photos are first analysed by the providers' moderation classifiers (in particular BytePlus/Seedance and MiniMax/Hailuo). A photo detected as showing a sensitive, nude or possibly underage face is refused by the provider and the credit is returned.
Refused content: deleted, never hosted. A photo refused by moderation is not kept: the file is deleted quickly (within a few days). Only moderation metadata (account, reason for refusal, image fingerprint/hash, timestamp) is kept for up to 12 months to prevent repeat attempts and to cooperate with the authorities. We never keep the problematic content itself.
Refusal counter. Each moderation refusal is counted on the user account. Beyond a certain threshold, or if abuse is suspected, Incarn may require identity verification (see section 6b) or suspend the account immediately.
Automated scanning, no human review. Photo moderation is fully automated (the AI providers' classifiers): no human operator views the uploaded photos. A human review may only take place exceptionally, following a report by a third party or a request from an authority, strictly as far as necessary.
Public reporting. Any user or third party can report unlawful content to [email protected]. Reports are handled as quickly as possible (Digital Services Act, Regulation (EU) 2022/2065).

6b. Identity verification (18+ procedure)

The Service is strictly reserved for adults. Identity verification is not requested by default; however, Incarn may require it case by case when an account shows serious signs of abuse (repeated moderation refusals, suspicious content, third-party report, account recovery request or any other concrete element suggesting use that does not comply with these Terms).

Level 1. Your surname, first name and date of birth, provided through a secure form.
Level 2. Level 1, plus a photograph of an official identity document (national identity card, passport or residence permit), checked manually by the administrator of the Service. This image is stored in an encrypted private space, accessible only through a short-lived signed URL (5 minutes), and each access is logged. No automated biometric processing takes place.
Refusing the verification leads to suspension of the account. Remaining credits are not refunded.
You guarantee that the information provided is accurate. Any false statement or forged document may lead to a complaint for forgery and use of forged documents (article 441-1 of the French Criminal Code).
The data provided is kept in accordance with our Privacy Policy.

6c. Preventing unlawful use

You must not use the Service to create, transform, distribute or attempt to generate content that is unlawful, non-consensual, misleading, defamatory, violent, hateful, sexual and involving minors, or that infringes the rights, image, privacy or dignity of others.

If unlawful or seriously abusive use is suspected, Incarn reserves the right to:

suspend or delete the account concerned, block generations in progress and restrict access to the Service;
keep the elements strictly necessary to prove the abuse (uploaded photos, moderation logs, IP addresses, timestamps, account information), for up to 12 months from the report or detection, or longer where a dispute, an investigation or a legal obligation requires it;
pass these elements, where necessary or legally required, to the competent authorities (judicial authorities, police and gendarmerie) or to authorised bodies (in particular the PHAROS platform of the French Ministry of the Interior for content involving child sexual abuse, under article 434-3 of the French Criminal Code);
share the strictly necessary information with associations or bodies specialised in protecting victims and children or fighting online abuse, within the limits of applicable law.

These measures follow the principles of necessity, proportionality and purpose limitation set by the GDPR and the French Data Protection Act. They are neither general monitoring nor automated reporting.

7. Results and quality

The Service uses artificial intelligence models whose results may vary with the quality of the source photo. Without prejudice to the legal guarantee of conformity (section 4.6), Incarn does not guarantee a specific artistic result or the accuracy of each movement. If generation fails for technical reasons, the credit is returned automatically.

8. Limitation of liability

Incarn does not guarantee that the Service will be permanently available without interruption. Nothing in these Terms limits the rights the law gives you, in particular the legal guarantee of conformity and the right of withdrawal.
For business users only: Incarn is not liable for indirect losses, and its total liability is limited to the amount actually paid over the last 12 months.
You alone are responsible for how you use the generated videos and films and for the consequences of sharing them.

9. Suspension and termination

Incarn may suspend or terminate, without notice or compensation, the access of any user who breaches these Terms, in particular in case of abusive, fraudulent or unlawful use. Unused credits are not refunded in case of suspension for breach of the Terms.

10. Personal data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

11. Changes to these Terms

Incarn may change these Terms. Any change is announced to you by email at least 30 days before it takes effect. A purchase remains governed by the version of the Terms accepted at the time of purchase. If you refuse the new version, you can delete your account at any time from your gallery.

12. Governing law and jurisdiction

These Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country of residence. Any dispute about their interpretation or performance will be brought before the competent courts under the ordinary rules of law.
