Incarn API Terms

API accounts are for businesses and developers. Keep your keys confidential: you are responsible for all usage made with them. Revoke a compromised key from your dashboard.

Usage is prepaid: either a monthly plan (Starter, Pro, Scale) or credits bought upfront. Prices exclude VAT. Payment is made by card through Stripe, in advance; invoicing in arrears is only available under a separate written agreement. One credit generates one animation. Credits added to your account do not expire while your account is open. You can cancel your plan at any time from your dashboard; cancellation takes effect at the end of the current billing period, which is not refunded. If an animation fails because of a technical fault on our side, the credit is returned automatically.

Videos generated through your API account are yours to use. Incarn grants you a worldwide, non-exclusive, perpetual right to use, reproduce, edit and distribute them, including commercially and as part of a service you sell to your own customers. Incarn claims no ownership of the videos and does not use them to promote its own service without your permission.

You must hold the rights to every photo you send, and the consent of the people who appear in them where the law requires it (or of their heirs, for deceased people where applicable). If you act for your own customers, you are responsible for obtaining their authorisation.

When you send photos of other people, you act as the data controller and Incarn processes the data on your behalf, solely to generate the animations you request. Incarn:

• processes the photos only on your instructions given through the API;
• keeps them confidential and protects them with appropriate security measures;
• uses only the subprocessors listed in its Privacy Policy (for example its AI providers and storage), each bound by equivalent obligations;
• helps you answer data subject requests;
• deletes the photos and videos when you delete them or close your account, as described in the Privacy Policy.

Our AI provider's option to use content for model training is switched off. Contact [email protected] for any data request.

The prohibitions and the moderation described in the Terms of Service apply to API use, in particular: sexual content, any content involving minors in an inappropriate way, animating a living person to deceive, harass or impersonate them, and any unlawful use. Incarn may refuse a photo, block a request or suspend an account that breaks these rules.

The videos are generated by artificial intelligence: the movement is imagined, not recorded. You must not present them as real recordings, and you must tell your end users that they are AI-generated.

You may use the Incarn name and logo to say that your product or service uses Incarn, for example "Animations by Incarn" or "Powered by Incarn", on your website, in your app and in your marketing. Use the logo as provided, without changing it. Do not present yourself as Incarn, or as an Incarn partner, reseller or official service, without Incarn's written agreement. Incarn may ask you to change or stop a use of its brand that is misleading or harms its reputation.

The API is provided "as is", with the limits of your plan (number of parallel generations). Incarn does not guarantee uninterrupted availability unless a separate written agreement says otherwise.

Incarn is not liable for indirect damages. Its total liability is limited to the amounts you paid in the 12 months before the event. You are solely responsible for how you use and distribute the videos.

Incarn may suspend or close an API account that breaks these terms, without notice in case of serious or unlawful use. You can stop using the API and close your account at any time.

Incarn will announce material changes to these terms by email at least 30 days before they apply. Continuing to use the API after that date means you accept them.

These terms are governed by French law. Any dispute about their interpretation or performance falls under the competent courts, according to the ordinary rules of law.
